Gary Gensler about himself in the third person: we are disappointed with the victory of Ripple

US Securities and Exchange Commission (SEC) Chairman Gary Gensler spoke yesterday about Ripple’s victory in court. He expressed his disappointment with the referee’s decision.

Last week, Judge Analisa Torres ruled: “XRP, as a digital token, is not in itself a “contract, transaction, or scheme” that fulfills the requirements of the Howie test for an investment contract.” The crypto community perceived this as a complete and unconditional victory for the company over the regulator. The trial lasted a long time – a lawsuit against Ripple and its leaders was initiated at the end of December 2020. According to the SEC, Ripple CEO Brad Garlinghouse, Ripple co-founder Chris Larsen, and the company itself have been involved in an “unregistered continuous offering of digital asset securities” to investors since 2013.

Gensler saidthat the SEC continues to evaluate the court’s decision and its implications:

We are disappointed with the outcome of the case in the context of the interests of retail investors. I can say that the court’s decision is still being closely studied. We evaluate it carefully.

Despite the defeat in the Ripple case, Gensler emphasized that the war on cryptocurrencies will continue: “We will continue to try to hold firms that may not comply with the requirements – regardless of faces and without prejudice – and will try to guarantee protection to investors.”
